THE WORKUP PHASE OF A CASE

After the initial meeting between Lawyer and Client, the case enters its workup phase. The workup phase of a case precedes the litigation phase of a case.

During the workup phase of a case, we take the information you gave us during the initial meeting and gather evidence to support it. We open up channels of communication with your Health Care Providers and with the Insurance Companies of the Defendants. We collect your medical records and reports. We may hire experts. We may get statements from witnesses. As we obtain records, we forward them to the Insurance Carrier of the Defendant for Settlement.Every case needs a strong foundation, and at Bosco & Mascolo we will develop a foundation that will support your case throughout its successful path to conclusion. There are no shortcuts when putting a successful strategy together for each case. No matter how simple the case may seem to you, it is always more complicated than that. Bosco & Mascolo will guide your case throughout the complicated legal process.

Keep in mind that as long as consequences are arising from the accident such has medical treatment, loss of work, etc. we need to gather evidence to prove it. So it is important that you inform us of any new consequences of which we might not be aware. For instance, during the initial interview you may have informed us of various Health Care Providers. We can track your visits to them because we know about them. However, after our initial meeting, if you visit a new Health Care Provider, it is important that you inform us so we can begin tracking that health care provider. This process can be very short or it can take a longer period of time. For example, if you have fallen and suffered a wrist injury, lets say a fracture to the wrist, and it was treated, casted, and it healed well with little follow-up treatment, your medical file workup will be completed in a relatively short period of time. But, in contrast, where your medical condition warrants continued treatment over an extended period of time, or where you are out of work for a lengthy period of time, the process to gather and exchange this information gets extended also. This alone will add to the time it will take to present your case. All the information is needed to present a successful case. Sometimes that means that patience is needed so that all the injuries can be presented.

Because consequence from an accident take place over the course of time, sometimes it is impossible to estimate the value of the case initially. Usually, after the six month to nine month mark in the life of a case, the value becomes clearer. Keep in mind, however, that valuation is guesswork. There is no formula into which we can plug your injuries and other consequences that will spit out the value of a case. Various factors come into play in evaluation a case. The same case in Staten Island bears a different value than a case in the Bronx. The same holds true for New Jersey. The same case in Atlantic County bears a different value than a case in Union County.
